On reargument and on the record on appeal, as amended, the decision of this court dated May 3, 1954 (283 App. Div. 948), and the order of reversal of the judgment entered thereon, are vacated, and the judgment of conviction is unanimously affirmed. It appears that the trial minutes were erroneous because of a stenographer’s errors, and that the trial judge used the word “stipulation” and not “speculation”. An order was made by the trial judge, correcting the minutes; a supplemental notice of appeal has been filed to include said order which is before this court by consent of the parties. In…
