1. -The appellee sued appellant on a policy of life insurance, and recovered judgment for $526.91.- The complaint was in one paragraph, was not demurred to, and is attacked for the first time by an. assignment of error. It is sufficient to bar another action for the same cause, and therefore proof against such assignment. Embree v. Emerson (1905), 37 Ind. App. 16.
