GREGORY, Circuit Judge:
On March 8, 2002, Cohen & Malad, LLP, an Indiana limited partnership, sued Resource Bankshares Corporation and Resource Bank (“Resource”) in Indiana state court on behalf of a class of recipients of Resource’s faxes. The lawsuit was based on the private right of action provided by the Telephone Consumer Protection Act, 47 U.S.C. § 227 (2003) (“TCPA”).
