On August 16, 1993, the Defendant, STS MicroScan, Inc. (MicroScan), filed a Motion to Dismiss, contending that the Plaintiff, Panean International Management Consultants, Inc. (Pancan), had “failed to plead any fact demonstrating that this Court possesses subject matter jurisdiction.” (Motion to Dismiss at ¶ 1.) On September 16,1993, Pancan filed an untimely pleading in opposition to MicroScan’s motion, as well as its own Motion for Leave to Amend Complaint.
