Hill, J,

Will Johnson and Chester Johnson were jointly indicted for the offense of murder. The indictment alleged that on November 21, 1922, the accused did kill and murder Peter G. Poulos by shooting Poulos with a pistol. The jury, on the trial of Will Johnson, returned a verdict of guilty, without recommendation; and he was sentenced to be hanged.
