The petitioner landlord commenced this holdover proceeding to recover possession of an apartment subject to the provisions of the Emergency Tenant Protection Act of 1974 (L 1974, ch 576, § 4, as amended by L 1983, ch 403 [Omnibus Housing Act of 1983]), upon the ground that the apartment is not the primary *846residence of the respondent tenant.
