This is an action by a broker to recover a commission for an exchange of lands. Other brokers were employed by the defendant and have been paid. But as unfortunately there is no process analogous to interpleader by which persons setting up mutually exclusive claims in contract can be brought together in one proceeding, the plaintiff had a right to make out, if he could, that he was the effective cause of the bargain. The chief question raised by the exceptions is whether there was any evidence which warranted the jury in giving him a verdict.
