Appeal from a judgment of the Supreme Court (Pritzker, J.), entered September 26, 2008 in Washington County, which denied petitioner’s application for a writ of habeas corpus, in a proceeding pursuant to CPLR article 70, without a hearing.

Petitioner is currently serving an aggregate term of 25 years to life in prison upon his conviction of murder in the second degree and attempted robbery in the second degree. His conviction was affirmed on appeal (People v Jackson, 173 AD2d 292 [1991], lv denied 78 NY2d 968 [1991]). He subsequently commenced the instant proceeding for a writ of habeas corpus…
