STAPLETON, District Judge:
This is an action brought by Kaiser Aluminum and Chemical Corporation challenging on several grounds 1 actions of the Consumer Product Safety Commission (hereinafter “CPSC” or “the Commission”) with respect to aluminum branch circuit wiring. Kaiser sought both preliminary and permanent injunctive relief. The Commission moved to dismiss the complaint. In an earlier Opinion I denied both the motion to dismiss and the request for a preliminary injunction.
