This case is before us for further appellate review on applications filed by both the defendant and the Commonwealth, after a decision by the Appeals Court. Commonwealth v. Chase, 11 Mass. App. Ct. 884 (1981).

We are asked to decide whether a prosecution of the father of an illegitimate child for criminal nonsupport pursuant to G. L. c. 273, § 15, 1 is constitutionally permissible without a prior adjudication of paternity. In addition, we are asked to determine whether a prosecution can be maintained under § 15 in the absence of evidence that the defendant knew or should have known of a claim…
