The Secretary of State appeals from an order of the Superior Court (Kennebec County, Alexander, J.) vacating the decision of a hearing examiner upholding the administrative license suspension of Ker-shaw Powell. Powell’s license had been suspended for operating a motor vehicle while having 0.08% or more by weight of alcohol in his blood.
