SWINFORD, District Judge.
This is an action arising under the Trade-Mark Act of 1946, 15 U.S.C.A. § 1114, which gives this court jurisdiction. The matter in controversy also exceeds, exclusive of interest and costs, the sum of three thousand dollars, is between citizens of different státes and therefore within the jurisdiction of this court under 28' U.S.C.A. § 1332(a) and § 1391 (a, c).
The plaintiff is an Ohio corporation with its principal office and place of business in Cincinnati, Ohio. It is the owner of U. S. trade-mark registration No. 604,061 for Inseet-O-Lite for electrically heated…
