*5 The petitioner and defendant below, David M. Wasanyi, a pharmacist, was convicted in two separate trials of multiple felony counts of unlawful delivery of a controlled substance in violation of West Virginia Code § 60A-4-401(a) (2014). In the case docketed as No. 16-1009, the petitioner was convicted of two counts of Delivery of Diazepam and sentenced to one to three years in the penitentiary for each conviction. He was also convicted of one count of Delivery of Buprenorphine and sentenced to one to five years in the penitentiary for that conviction. The trial court ordered…
