The plaintiff and the defendant were married a number of years ago, but, because of the cruel treatment of *560the husband, they were, on February 9, 1897, living separate and apart from each other. On that day, they entered into a written contract setting forth that differences had arisen between them which rendered it undesirable that they should live together, and that théy had, in fact, theretofore separated.
