In his petition for a writ of habeas corpus, Jacob Toler alleges that he was convicted in the County Court, Suffolk County, New York, of the crime of forgery in the second degree on May 19, 1937; that he was sentenced as a fourth felony offender to a term of 15 years to life pursuant to section 1942 of the New *268York Penal Law, McKinney’s Consol.
