This is an appeal by the plaintiff, Balph Bouma, from a judgment entered in the district court of the ninth judicial district of the State of Montana, in and for Teton County, denying an injunction and damages.

The plaintiff in his complaint alleged that the defendant, Bynum Irrigation District, a public corporation, was the owner of a ditch or canal known as “C” canal which ran through plaintiff’s land.
