—In an action to recover damages for breach of an indemnity agreement, the defendant appeals from (1) an order of the Supreme Court, Queens County (LeVine, J.), dated August 26, 1997, which granted the plaintiff’s motion to confirm the report of a Judicial Hearing Officer (Leviss, J.H.O.) dated January 10, 1997, and denied the defendant’s cross motion to reject the report, and (2) a judg*307ment of the same court entered September 4, 1997, which is in favor of the plaintiff and against him in the principal sum of $400,000.
