This was an action upon two promissory notes, commenced by the plaintiffs in error, plaintiffs below, against the defendant in error, defendant below, prior to statehood.
The petition alleges, in substance, that the incorporated town of Roff entered into a contract with plaintiffs for the purchase of two chemical fire engines and equipment, under the terms of a certain written contract.
