Appellant was charged, tried, and convicted of driving and operating a motor vehicle upon and along Fourth Street, a public highway, in Fort Wayne, Allen County, Indiana, while under the influence of intoxicating liquor, in violation of section 1, chapter 126, Acts of 1937, section 47-417 Burns’ Ann. St. Supp. 1937. By this appeal he challenges the sufficiency of the evidence and claims that there was no proof that he operated a motor vehicle on said street or that he was intoxicated.
In considering the evidence we will look only to that most favorable to the state, and the finding of guilty…
