Plaintiff Deutz-Allis appeals from the granting of a partial summary judgment to defendant Gulf Insurance Company; the granting of summary judgment to defendant Phillips; 1 the granting of partial summary judgment to defendant Terry Clenney; and the denial of its motion for summary judgment. The action was a claim against the bond posted by Sheriff Phillips pursuant to OCGA § 15-16-5, on which Gulf was the surety, and against Clenney as surety ori a bond under OCGA § 44-14-268 (a) (2).
