This'is the third appearance of the controversy concerning the will in question in this court. 'The first case is reported in 17.0 Wis. 436, 175 N. W. 917,- and the second in 175 Wis. 1, 183 N. W. 888. The curious and interesting facts relating to the execution of the will are fully reported in the statement of facts on the first appeal. In that case it was held that under secs. 2284 and 4068 of the Statutes as they stood in 1895 when the will was executed, a residuary legatee was a competent subscribing witness to a will, the common-law disqualification having been wiped out and sec. 4069…
