It is ordered that this motion by the plaintiff for an order pursuant to CPLR 3212 granting summary judgment in its favor and striking the answer of the defendant Linda Fitzpatrick, also known as Linda J. Fitzpatrick; appointing a referee to ascertain and compute the amount due; amending the caption of this action by substituting Haley Lanzafame for John Doe No. 1 and *748striking out John Does Nos. 2-10; and striking the notice for discovery and inspection of defendant Fitzpatrick pursuant to CPLR 3122 (b) is denied.
