MEMORANDUM AND ORDER

GILES, District Judge.

The issue raised by defendants’ motion to dismiss is whether either under the principles of res judicata or collateral estoppel this federal action for damages for alleged violations of constitutional and statutory rights 1 is barred by reason of a prior state court proceeding. There, plaintiff’s discharge from public employment was upheld on the same matrix of facts, according to defendants, as is involved in this action. 2
