Appeal by the defendant from a judgment of the Supreme Court, Queens County (Rios, J.), rendered June 12, 2003, convicting him of murder in the second degree, assault in the *500second degree, and criminal possession of a weapon in the third degree, upon a jury verdict, and imposing sentence.

Ordered that the judgment is modified, on the law, by vacating the conviction of murder in the second degree, vacating the sentence imposed thereon, and dismissing that count of the indictment; as so modified, the judgment is affirmed.
