Appeal from a judgment of the Supreme Court, entered in the New York county clerk’s office on the 39th day of June, 1915, upon the decision of the court setting aside a separation agreement. Judgment affirmed, with costs. Present — Clarke, P. J., McLaughlin, Dowling,-Smith and Davis, JJ.; McLaughlin, J., dissented.

The plaintiff and defendant Benjamin P. Ducas were married in August, 1900, and separated shortly prior to the *8851st of December, 1906, the defendant Robert N. Ducas being their only child. On the 1st of December, 1906, they entered into an agreement by which it was stipulated they were to live separate and apart, Mrs. Ducas to have the care and custody of the son, under certain conditions, and Mr. Ducas to pay her $4,000 annually for her support and maintenance during life, and $2,000 annually for the education and maintenance of the son during his minority.
