This is an appeal from a judgment entered on an order granting defendant’s motion for judgment on the pleadings. The admitted facts, according to the pleadings, are in substance as follows:
On December 31, 1909, one Joioe signed a written instrument in which he promised to pay $3,000 to the defendant or order at a bank at Lake Mills, Iowa, on or before July 1, 1910, with interest at 5 per cent.
