MEMORANDUM AND ORDER

On September 25, 2002, plaintiffs Robert and Josephine Luizzi commenced this personal injury action against defendants Pro Transport, Inc. (“Pro Transport”) and Luis Sanchez (“Sanchez”) in New York Supreme Court, Kings County, seeking damages for injuries suffered by Robert Luizzi during a traffic accident that occurred on September 22, 2001.
