The State of Washington appeals the trial court’s dismissal of counts 1, 2, 3, and 4 of an information charging Timothy Warner with five counts of rape of a child in the first degree. The dismissal was based on a finding that the use of disclosures made during court-ordered treatment of a juvenile offender to prosecute that person after he turns 18 violates due process. The Respondent, Timothy Warner, cross-appeals the trial court’s finding that there was no pre-accusatorial delay justifying dismissal of the charges.
