PRENDERGAST, Judge.

On May 19, 1910, the grand jury of Reeves County indicted the appellant for unlawfully engaging in and pursuing the occupation and business of selling intoxicating liquors in justice precinct No. 1, of Reeves County, Texas, after prohibition was properly carried by a vote of the'people and the prohibition law declared in force in said justice precinct.
