Appellee’s intestate, who was five and one-half years of age, resided with her parents three-quarters of a mile north of Fayville and % about 200 feet from appellant’s track. On December 5, 1922, the child was struck and killed by one of appellant’s trains. Her mother ivas appointed administratrix and this suit, brought to recover for her death, resulted in a verdict and judgment for $1,800. The case went to the jury on the third and fourth counts of the declaration as amended.
