Appeal from special term, Rockland county. Application' by Wilhelmina Deckelmann and others for an order authorizing and requiring John H. Braunsdorf, as trustee, to repair a building belonging to the trust estate. The application was granted, and the trustee appeals.

The appellant is trustee under the will of his father, Julius Braunsdorf. The trust is substantially to hold a share of the testator’s estate during the life of his daughter, income to be paid to her during life, and, upon her decease, the share to go to her children or descendants. On the death of the testator’s widow, the appellant received, as part of the corpus of the trust, a dwelling house and a sum of money on deposit in the savings bank.
