Plaintiff is a member of the Wacs, being in Syracuse on a temporary leave. Her husband, the defendant, is a member of the armed forces. Through a guardian ad litem, plaintiff seeks an annulment of a ceremonial marriage performed November 13, 1941, by a Justice of the Peace. Defendant appears also by an attorney and does not contest plaintiff’s claims, based (first) upon the ground that the ceremony was performed by a Justice of the Peace, who had no statutory authority to perform a marriage, either or both of the parties being at the time under the age of 21 years, and (secondly) upon the…
