CannaKorp, Inc. (“CannaKorp” or “Plaintiff’) brings this action against the United States (“Defendant”) to challenge a pre-importation ruling issued by U.S. Customs and Border Protection (“Customs” or “CBP”). See Compl., ECF No. 2. Defendant moves to dismiss the complaint for lack of subject matter jurisdiction and failure to state a claim pursuant to Rules 12(b)(1) and 12(b)(6) of the Rules of the United States Court of International Trade (“USCIT”).
