Smith Carter, who was 89 years old, owned a tract of land in Pike county, Kentucky, containing between 600 and 900 acres, and worth, according to the proof, from seven to ten thousand dollars, upon which he and his wife, the defendant, Sarah Carter resided, the latter being 88 years of age. The husband also owned a small amount of live stock, household and kitchen furniture and a few farming implements. He also drew a pension, of $30.00 per month from the Federal Government.
