At the Fall Term of the Circuit Court in and for Gulf County, Florida, 1930, the plaintiff in error, Jim Scott, was indicted for the crime of murder in the first degree, charging Jim Scott with having murdered one C. L. Land on the 15th day of July, 1930. The record in this ease discloses:
