The plaintiff association commenced this action in the superior court for Spokane county seeking foreclosure of a chattel mortgage upon a stock of merchandise situated in the city of Spokane, in that county, which mortgage was executed and delivered by Weinstein Bros., a copartnership consisting of Moe, Abe and Joseph Weinstein, the then owners of the stock of merchandise, to the association in trust for the benefit of their creditors.
