Appeal from an order of the Supreme Court, Oneida County (Erin E Gall, J.), entered August 17, 2012. The order granted the motion of defendant Rite Aid of N.Y., Inc., doing business as Rite Aid Pharmacy, to dismiss the complaint and cross claims against it.
It is hereby ordered that the order so appealed from is unanimously affirmed without costs.
