Armstead v. James
Supreme Court of Virginia
1Per curiam
Plaintiff Peggy Armstead was injured in July of 1975 in Williams-burg when the motor vehicle in which she was a passenger collided with another driven by defendant Edgar James. Plaintiff appeals from a judgment entered on a jury verdict in her favor for $2,000, an amount which she claims was inadequate. The dispositive issue, however, is whether, as plaintiff also claims, the trial court misdirected the jury. We think that it did and reverse.
Defendant admitted liability so plaintiff’s evidence adduced at trial was limited to the issue of damages. Defendant offered no evidence.
