— A recital of the primary facts is necessary, to understand the nature of the appeal. On the 27th day of September, 1927, the grand jury of Plymouth County, Iowa, returned an indictment against the defendant Herbert Arioso, accusing him of the crime of stealing a motor vehicle. His bond was fixed at $2,000, and September 30, 1927, at 9 A. M., was set as the time for arraignment. On September 30, 1927, the defendant appeared in person and by counsel, waived arraignment and time to plead, and entered a plea of not guilty.
