APPEAL from a judgment of the Superior Court of Contra Costa County and from an order refusing a new trial. R. H. Latimer, Judge. The facts are stated in the opinion of the court.

The defendant was charged, in an information filed in the superior court of the county of Contra Costa, with the offense defined by section 149 of the Penal Code, which reads as follows: “Every public officer who, under color of authority, without lawful necessity, assaults or beats any person, is punishable by a fine not exceeding $5,000, and imprisonment in the county jail not exceeding five years.” The defendant was convicted, and sentenced to pay a fine of $1,000, and to be imprisoned in the county jail for one year.
