This is an action of trespass on the case for negligence to recover damages for injuries to person and property sustained by the plaintiff, on account of his automobile being run into by an automobile owned by the defendants and operated by their servant. The jury returned a verdict for the plaintiff and assessed damages in the sum of $3,278.00. The defendants duly filed a motion for a new trial alleging the usual grounds. The trial justice found that the damages awarded were excessive and ordered a new trial of the case unless the plaintiff would remit so much of the verdict as was in excess…
