Defendant-Appellant executed to Plaintiff-Respondent a written contract of purchase and sale of certain real estate within the City of Greenville agreeing for the consideration therein stated to convey to plaintiff said premises by good, warranty deed, free of encumbrances, liens, or assessments. Plaintiff engaged, as attorney, a reputable member of the Greenville Bar to examine and pass upon the title to said property and to close out the transaction.
