BAMSEY, Judge.—This
is an appeal from a conviction for murder in the first degree with the death penalty assessed.
If the testimony for the State is to be believed' the killing of Ephram Bass was a most heartless and cold1 blooded killing. On the part of the State, the facts show that about 5 o’clock p. m. of the 14th of October, 1907, on the public streets of the city of Galveston, the appellant walked out of an alley on to Thirtieth Street and Avenue M with a pistol in his hand; walked up to the deceased, Ephram Bass, and when he did so the deceased threw up his hands and requested defendant…
