This case involves an action for damages by the plaintiff, as administratrix, for injuries received by her husband while riding as a passenger upon the defendant’s car on lower Washington street in the City of Bath alleged to have been caused by the defendant’s negligence.

The facts show that the plaintiff’s intestate boarded an open car *485going northerly toward Bath in the early evening. At first he sat upon one of the rear seats.
