DICKSON, Justice.

The defendant, Howard Steele, was convicted of rape, a class A felony; criminal deviate conduct, a class A felony; confinement, a class B felony; robbery, a class B felony; and battery, a class C felony. In this direct appeal the defendant's contentions concern the following: (1) the trial court's refusal to grant a mistrial; (2) its refusal of defendant's tendered jury instructions on lesser included offenses; and (8) sufficiency of the evidence of robbery as a class B felony.
