Defendants have been charged in felony complaints with various offenses including the class C felony of criminal possession of a weapon in the second degree (Penal Law § 265.03 [3]). It is alleged that defendants were passengers in a vehicle in which a loaded gun was recovered. The People seek orders pursuant to Matter of Abe A. (56 NY2d 288, 291 [1982]), compelling each defendant to submit to a buccal swab for the purpose of collecting a DNA sample in order to determine if his DNA matches DNA from swabs of the gun.
