This case arises from a longstanding commercial dispute between an administrative agent for a group of lenders that extended credit to a company, and the owner and his trust for the company. Because the district court: 1) properly interpreted the language of the guaranty to hold the owner responsible for the full payment of costs and expenses under the final judgment; 2) properly denied the owner relief under Fed. R. Civ. P. 60(b)(5) and determined that there was no partial satisfaction of the attorney fees and expenses; and 3) properly determined that the…
