This action was brought to recover damages for failure to deliver silk shirtings, according to contract.

The complaint alleges that on or about the 20th day of March, 1919, the plaintiff and the defendant entered into an agreement in writing, a copy of which is annexed and made part of the complaint. The exhibit recites that the plaintiff, styled the Shirt Company, has presented to the defendant, known as the Silk Company, an order in writing dated March 20, 1919, calling for the sale and delivery by the Silk Company to the said Shirt Company of 400 pieces of shirting No. 910 at $1.60 per…
