By information filed in the court below, plaintiffs in error were jointly charged in two counts, (1) with breaking ore from certain mines with intent to steal; and (2) with removing ore from the same premises with intent to defraud. The information in this case was based upon the provisions of section 3234, 2 Mills’ Ann.
