The case is thus stated by Mr. Justice Tayloe: “ Action to recover the value of a quantity of pine logs which plaintiff claims to own, and which he alleges to have been unlawfully converted by the defendant. It appears that the logs were cut and banked by Langley & Plaisdell, under a contract between them and one S. M. Newton, in the season of 1818-9.
